Less than one year after ruling to overturn Roe v. Wade the Supreme Court is getting a second huge abortion case.

And Brett Kavanaugh is facing one decision that could put lives at risk.

The abortion issue changed drastically last year when the U.S. Supreme Court finally overturned the incorrectly decided Roe v. Wade case, which forced all states to allow abortions.

The DOJ “strongly disagrees”

The Department of Justice (DOJ) is asking the Supreme Court to intervene in the Texas chemical abortion pills case.

Attorney General Merrick B. Garland said the DOJ “strongly disagrees with the Fifth Circuit’s decision in Alliance for Hippocratic Medicine v. FDA.” 

The Fifth Circuit granted in part the government’s emergency motion for a stay pending appeal on a Texas federal judge’s decision to suspend Food and Drug Administration (FDA) approval of the chemical abortion pill.

The Fifth Circuit’s ruling allows the suspension on relaxed rules introduced by the FDA after 2016 to stand, but also allows the deadly pill’s distribution and sale to continue while the appeal works its way to the U.S. Supreme Court.

The good news is the Fifth Circuit ruling severely limited the distribution.

Biden DOJ seeking emergency relief from Supreme Court

After 2016, the FDA shockingly loosened restrictions on the sale and distribution of allowed distribution of the deadly chemical abortion pill.

They allowed the dangerous drug to be attained through the mail and extended the latest point it could be used during pregnancy to 10 weeks.

But just weeks ago, Texas Judge Matthew Kacsmaryk issued a ruling applauded by Pro-Life leaders and activists.

The judge ruled the FDA had acted improperly and ordered the mail distribution of the dangerous abortion pill be stopped in all 50 states.

The Biden DOJ appealed the ruling to the Fifth Circuit Court of Appeals, but that court also ruled the FDA was wrong, and though it allowed the distribution of the pill during the appeals process, it severely restricted it.

Now the Biden administration, happy to show how little it cares for human life, has appealed to the U.S. Supreme Court.

“We will be seeking emergency relief from the Supreme Court to defend the FDA’s scientific judgment and protect Americans’ access to safe and effective reproductive care,” Garland said.  

But Pro-Life leaders and activists alike celebrated the Fifth Circuit’s partial block and say they are looking forward to the case arriving at the Supreme Court.

“A significant victory” for life

Alliance Defending Freedom Senior Counsel Erin Hawley, who represented the plaintiffs in the original Texas case said, “The Fifth Circuit’s decision is a significant victory for the doctors we represent, women’s health, and every American who deserves an accountable federal government acting within the bounds of the law.” 

And Susan B. Anthony Pro-Life America’s State Policy Director Katie Daniel said her organization is “very encouraged” by the ruling.

“The Court recognized that the abortion pill is dangerous and rolled back Biden’s reckless mail-order abortion scheme. We still believe it never should have been approved in the first place and we look forward to the Supreme Court hearing this case,” stated Daniel.

As all signs show the Supreme Court will take up the case, Pro-Lifers and all Americans who oppose the wholesale slaughter of the preborn are praying their decision is swift and sure.
