Costco refused to stock the abortion pill in its more than 500 pharmacies after faith-based investors pushed back.
Now pro-life shareholders have taken that same fight to FedEx, and they came armed with a chocolate egg.
And an 1873 law already on the books has FedEx's name written all over it.
Kinder Eggs Are Banned From FedEx but Mifepristone Abortion Pills Are Not
At FedEx's annual meeting on September 28, Pia de Solenni of IWP Capital, a Catholic investment advisory firm, presented a resolution drafted by lawyers at Alliance Defending Freedom.
It asked FedEx to spend the next year evaluating "how it oversees risks related to distributing mail-order abortion drugs such as mifepristone."
It did not ask FedEx to stop a single shipment.
It did not ask FedEx to open a single box.
It asked for a report.
"FedEx prohibits the shipment of Kinder Surprise Eggs," de Solenni told The Daily Wire. "If the company can prohibit a candy toy, it can prohibit a drug that violates the law in more than 20 states and has harmed a growing number of women, not to mention destroyed countless human lives."
Federal rules keep Kinder Surprise Eggs out of American stores because a child could choke on the plastic toy hidden in the chocolate.
Cigarettes, cigars, vapes and cash are on the FedEx no-ship list too.
FedEx Board Says an Abortion Pill Shipping Report Is Not Worth the Money
The board urged shareholders to vote no.
"If adopted as proposed, the proposal would result in unnecessary expense and burdens with limited benefit to our stockholders," the board wrote.
Shareholders followed the board's lead, and the proposal drew about 1 percent of the vote.
FedEx is headquartered in Memphis, in a state that bans nearly every abortion.
Seventeen states now protect most unborn babies from abortion, either from fertilization or after six weeks.
Rosalie Markezich Never Ordered the Mail-Order Abortion Pills That Came to Her Door
FedEx's board talks about "limited benefit."
Rosalie Markezich knows the cost.
In 2023, her boyfriend used her email to order abortion pills from a California doctor without her knowledge, according to her court filings.
The doctor never spoke to her, and the pills were mailed straight to her Louisiana home.
She says it was a coerced abortion, and she was pressured into taking them.
"The trauma of my chemical abortion still haunts me," she said in court filings.
Louisiana Attorney General Liz Murrill called her a woman "bravely representing many women who are victimized by the illegal, immoral, and unethical conduct of these drug dealers."
A shipping company has no way of knowing who ordered the package or who will be forced to swallow what's inside.
And the danger does not end with coercion.
An Ethics and Public Policy Center study of 865,727 mifepristone abortions found 10.93 percent of women suffered sepsis, infection, hemorrhaging or another serious adverse event within 45 days.
The Comstock Act Bans Abortion Pills by Mail and Names Companies Like FedEx
The Comstock Act does not stop at the Post Office.
Under 18 U.S. Code 1462, it is a federal crime to knowingly use "any express company or other common carrier" to ship "any drug, medicine, article, or thing designed, adapted, or intended for producing abortion."
FedEx is an express company.
In December 2022, Joe Biden's Office of Legal Counsel decided the law does not apply unless the sender intends the pills to be used illegally.
Todd Blanche, President Trump's attorney general, told senators he would review that opinion.
When the Supreme Court let mail-order mifepristone continue in May, Justices Clarence Thomas and Samuel Alito dissented, and Thomas pointed straight at Comstock.
"The Comstock Act says it's illegal to put these drugs in the mail, so we're just asking them to enforce the law," said Doug Truax, CEO of the Restoration of America Foundation.
Costco and Walgreens Show Pressure Over the Abortion Pill Works
One lopsided vote does not end this fight.
It is the opening move.
Costco never faced a vote at all.
In August 2025, Inspire Investing pressed the company, and Costco announced it would not sell mifepristone, citing "the lack of demand from our members."
In 2023, 20 Republican attorneys general warned Walgreens that Comstock barred mailing the pill, and Walgreens agreed not to dispense it in their states.
Gavin Newsom threw a tantrum.
"California won't be doing business with Walgreens or any company that cowers to the extremists and puts women's lives at risk," he said.
Walgreens learned that saying no to the abortion pill can cost a state contract.
FedEx is about to learn that saying yes can cost far more.
Newsom does not enforce federal law.
Todd Blanche does.
The day the Justice Department tosses the Biden memo, a report on abortion drug risk will look like the cheapest insurance FedEx ever turned down.
Rosalie Markezich and women like her are the reason pro-life shareholders will be back next year.
